LAW AND JURISDICTION
This website was created and operates under the terms of Portuguese law. Access to this site is subject to acceptance of these conditions and any dispute relating to it will be governed by Portuguese legislation in force, with only the courts of the district of Setúbal being competent, with express waiver of any other. In the event that any of the conditions is considered, by virtue of a judicial decision, null, illegal or unenforceable, this will not affect the remaining conditions, which will remain valid to the maximum extent legally permitted.
SCHEDULE
Service proposals (price, location, other information) will only be valid for each specific activity and dates presented in the proposal, as other similar events may take place, but with other conditions. The description of each service on our website and in the personalized proposals sent to customers is abbreviated but as explicit as possible. However, the content and format of the services may change slightly depending on the time of year and weather conditions. Possible changes will be communicated when confirming your reservation. The activity programs provided to customers include a detailed description of the activities, such as rules of conduct, general and specific conditions, prices, among other information. Activity participants should therefore be aware of the repetitive activity schedule.
TIME
The duration of activities is given only as an indication and approximate, depending on factors external to the guides. A tolerance of 15 minutes will be given for all participants to gather at the meeting point defined for each program and activity.
BOOKING/PAYMENT
All activities and programs on the Ultra Aventura Sports website are owned and marketed by LCPF - Ultra Aventura Sports Unipessoal Lda and under the Ultra Aventura Sports brand.
In order to enroll in any Ultra Aventura Sports activity, you must obligatorily make your reservation, via the reservation form on our website – www.ultraaventura.pt - or to the e-mail info@ultraaventura.pt, meaning that in this act you are purchase the requested service and agree with the General and Specific Conditions of the activity. In this way, you assume the commitment to pay all the services provided in the activity for which you made your reservation.
To make payments, you can use the following channels:

Proof of payment must be sent by e-mail to the employee accompanying the process, or to info@ultraaventura.pt.

Cash – Only possible for payment of the remaining value of the activity, and to be paid on the day of the activity.

Paypal - Ultra Aventura Sports offers an updated form of payment through a secure online payment platform, with the website: www.paypal.com.
If you wish to issue a Receipt, you must request it from us when paying for the activity, together with your name, address and VAT number.
When registering/booking, the Client assumes some commitments to Ultra Aventura Sports:
Having become aware of and accepting these Terms and Conditions of participation, as well as the activity program in which the Client signs up, which constitutes the particular conditions of participation in the activity;
That he is in adequate health conditions for the activity in which he is enrolled and accepts the nature of it, namely the risks arising from the impossibility of immediate access to medical assistance;
You must always inform Ultra Aventura Sports if you suffer from any chronic illness or any other that prevents you from practicing this activity. If you have permission from your doctor to participate, you will need to provide us with a medical certificate;
That he is aware of the type of physical and psychological demands that the activity involves and that could lead to extreme and unforeseen situations.
REFUNDS AND CANCELLATIONS/CHANGES/CANCELLATION
In case of need to cancel an activity, for reasons beyond our control (for example: extreme weather conditions that put the safety of participants at risk), we will notify you as soon as possible and present an alternative date of your convenience or, in some cases, there may be a full refund of the reservation amount, if there are no previously assumed commitments with third parties.
Ultra Aventura Sports reserves the right to cancel activities in the following cases:
The minimum participants required for each activity are not met;
Meteorological or other conditions make it impractical;
There are no minimum security conditions for holding the event;
The conditions set out in the particular conditions are not met;
The realization of many activities is dependent on weather conditions. If any activity is canceled due to weather conditions, a new reservation will be offered, but always subject to the weather conditions of the respective day.
In the event of cancellation of the reservation by the customer, you may receive a full refund of your payment and under the following conditions:
In the case of activities of just 1 day, you will receive a full refund if you cancel up to 72 hours before the start of the activity and if Ultra Aventura Sports , following the reservation made, has not already made commitments before other operators involved in the activity;
In the case of sold-out events, Ultra Aventura Sports does not refund amounts already paid.
In activities lasting more than 1 day and taking place in mainland Portugal, cancellation must be made up to 30 days before the start of the activity, otherwise you may incur payment of expenses already incurred, or total loss of the amount paid;
In activities lasting more than 1 day and taking place on the Islands (Azores and Madeira) and outside the national territory, cancellation must be made up to 45 days before the start of the activity, otherwise you may incur the payment of expenses already incurred, or total loss of the amount paid.
TRANSPORT
The itineraries are included in the programs only as an indication and the route is subject to change. In the services provided by us, unless expressly stated otherwise, any type of transport or transfer is not included.
SAFETY RULES
Ultra Aventura Sports activities scrupulously comply with safety standards, reducing the risks associated with the activities developed by us. However, participants should be aware that due to the nature of the activities the risk cannot be reduced in its entirety.
Participants in Ultra Aventura Sports activities must undertake to follow certain rules of conduct, which respect their own safety, that of other people (participants in activities or not) and nature. The company LCPF - Ultra Aventura Sports Unipessoal Lda and its collaborators will not be responsible for improper behavior of the participants during the activities, being able, however, to conclude an activity if the security conditions or the minimum norms of conduct are in question.
It is the customer's responsibility to ensure that he or she is in good health to carry out the respective activities. Certain activities presuppose the verification of certain conditions in the person who performs them, such as minimum age, state of health and other physical and psychological requirements.
When possible, such restrictions will be indicated in the proposal sent to the client, being advised to read it carefully after receipt.
RESPONSIBILITY

Civil Liability Insurance, which covers property and non-property damage to third parties and Customers, which may be attributed to us in the exercise of our activity.

Accidents and Activation of Personal Accident Insurance (SAP)
All insurance held by Ultra Aventura Sports will be in a position to be activated within the period of time in which the activity/program in which the Client signed up takes place. The date and time described in the program is stipulated as the beginning of this period of time and it will end on the day and time on which the Client abandons the activity/programme, even if he/she leaves it in advance and definitively or if he/she resumes it later on. Whenever the Client wishes to abandon the activity/programme, he must inform the Ultra Aventura Sports Guide/Monitor.
Accidents that can be triggered by SAP are considered to be all those that occur as a result of the normal development of the activity described in the program in which the Client is participating or in any alteration introduced thereto by Ultra Aventura Sports.
Accidents may not be subject to SAP activation under the following circumstances:
When the Customer, on his own initiative, is carrying out any activity outside the scope and normal development of the activity described in the program or as a result of risky behavior that is unnecessary for the activity in which the Customer is participating;
When the Client, on his own initiative and against the instructions of the Ultra Aventura Sports Guide/Monitor responsible for the activity on the ground, decides to make changes to the route or to the program described and in which the Client is participating;
When any safety rule previously established by the Guia/Monitor Ultra Aventura Sports is consciously exceeded by the Client;
Any and all Accidents that can be activated by SAP must be communicated to the Insurance Company, up to a maximum of 72 hours after the conclusion of the activity in which the accident occurred.
OTHER INFORMATION
All content on the Ultra Aventura Sports website (texts, photographs and information) is protected by copyright and cannot be used without prior authorization from Ultra Aventura Sports. The images collected by the participants during the activities carried out by Ultra Aventura Sports may be used for the purposes of disclosing its services on our website and social networks. If you do not agree with this policy, you must inform the company by email (info@ultraaventura.pt) that you do not authorize the use of your photos in publicizing our events, in the website gallery and social networks. If you want to see your images published with your credits, you should always put your name on the images you send us.
